These Terms of Service ("Terms") govern your use of Somclick's website and services. By purchasing or using any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

Services

Somclick provides web design, web hosting, domain registration, email hosting, SSL certificates, CMS development, website migration and related digital services. Specific terms for each service are outlined in your order or proposal.

Acceptance of Terms

By placing an order or using our services, you confirm that you are at least 18 years of age, or have the consent of a legal guardian, and that you have the legal capacity to enter into this agreement.

Payment & Billing

• All prices are quoted in South African Rand (ZAR) and include VAT where applicable
• Domain and hosting services are billed on an annual or monthly basis as specified at purchase
• Invoices are due upon receipt unless otherwise agreed in writing
• Failure to pay may result in suspension or termination of services
• Domain registration fees are non-refundable once a domain has been registered

Refunds & Cancellations

Hosting services may be cancelled at any time; refunds are pro-rated at our discretion. Web design projects are subject to the specific terms outlined in your project proposal. Domains are non-refundable once registered. To cancel a service, please contact us in writing at hello@somclick.com.

Acceptable Use

You agree not to use our services to:

• Host or distribute illegal, harmful, abusive or fraudulent content
• Send unsolicited bulk email (spam)
• Infringe on intellectual property rights of others
• Engage in activities that overload or disrupt our infrastructure
• Attempt unauthorised access to any system or network

Violation of this policy may result in immediate suspension of services without refund.

Uptime & Service Availability

We aim for 99.9% uptime for all hosting services. Scheduled maintenance will be communicated in advance where possible. Somclick is not liable for downtime caused by factors beyond our control, including third-party network outages or force majeure events.

Intellectual Property

Upon full payment, you own the final deliverables of any web design project. Somclick retains the right to display completed work in our portfolio unless you request otherwise in writing. Third-party assets (fonts, stock images, plugins) are subject to their own licences.

Limitation of Liability

To the maximum extent permitted by South African law, Somclick shall not be liable for any indirect, incidental or consequential damages arising from the use or inability to use our services. Our total liability shall not exceed the amount paid for the service in the 30 days preceding the claim.

Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of South African courts.

Changes to These Terms

We may update these Terms from time to time. Continued use of our services after changes are published constitutes acceptance of the revised Terms.
